A shop workers’ union has won a Supreme Court battle against Tesco over so-called “fire and rehire” plans put forward by the supermarket group.
The row erupted in 2021 after Tesco proposed firing staff at some distribution centres and rehiring them on lower pay.
The Usdaw union said it was “delighted to get this outcome”.

- If there was an error, it was possibly in failing to impose a time limit on the enhanced pay at the start.
- Given it was limited to a small number of employees…
- …it would perhaps be wiser/pragmatic to let the arrangement ‘time out‘ via natural attrition.
- i.e. the said employees reaching retirement age or leaving of their own accord…
